By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Account Registration and Security

3.3 Pricing Changes

We reserve the right to change our pricing at any time with 7 days' notice to existing subscribers. However, if you have an active subscription at the time of a price change, you will continue to pay your current rate for as long as you maintain that subscription without cancellation. This grandfathering provision applies to:

• Monthly subscriptions that remain active without cancellation
• Annual subscriptions for the duration of each renewed term
• Lifetime purchases, which are permanently locked at the original purchase price

If you cancel your subscription and later resubscribe, you will be subject to the current pricing at that time.

3.4 Lifetime Purchase Terms

Lifetime purchases provide permanent access to premium features with the following terms:

• One-time payment with no recurring charges
• Permanent access to all current premium features
• Automatic inclusion of future premium updates and improvements at no additional cost
• Access remains valid for the lifetime of the service, unless terminated for violation of these Terms
• Subject to the 3-day refund policy outlined in Section 4 (for eligible first-time premium users only)

3.5 Payment Obligations

By using our premium services, you agree to:

• Pay all fees associated with your subscription and premium model access
• Provide current, complete, and accurate payment information
• Promptly update your payment information if it changes
• Accept the terms and conditions of our payment processor, Stripe
• Use premium models and features only as authorized by your subscription tier

Premium model access will be suspended if payment fails or subscription expires. Subscription fees are non-refundable except as outlined in Section 4 (Refund Policy) or as required by law.

4. Refund Policy

4.1 First-Time User 3-Day Refund Window

Annual and Lifetime purchases are eligible for a full refund within 3 days of the purchase date, but only for first-time premium users. This refund policy applies exclusively to users who have never previously purchased or used any premium subscription or features on Axols Local AI Tools.

To be eligible for a refund:

• You must be a first-time premium user with no previous premium purchases or subscriptions
• The purchase must be your first Annual or Lifetime purchase on our platform
• Submit your refund request through our Contact Us page
• Include your account email and order details
• Refund requests must be received within 3 days (72 hours) of purchase

Important: Users who have previously purchased any premium subscription (weekly, monthly, annual, or lifetime) or used premium features are not eligible for the 3-day refund, regardless of whether those previous subscriptions were active, cancelled, or expired.

4.2 Refund Processing

Once a refund is approved:

• Your premium access will be immediately revoked
• Refunds will be processed within 15 business days
• Refunds will be returned to the original payment method
• Stripe processing fees may not be refunded, as these are charged by the payment processor

4.3 Non-Refundable Subscriptions

The following are non-refundable:

• Weekly and monthly subscriptions (no refunds provided for any billing period)
• Annual and Lifetime purchases by users who have previously had premium subscriptions or access
• Any purchase made more than 3 days prior to the refund request
• Purchases made by users who have previously utilized the 3-day refund policy

You may cancel recurring subscriptions at any time, but no refunds will be provided for the current billing period.

4.4 Exceptions

We reserve the right to issue refunds outside of this policy in cases of:

• Service errors or technical failures on our part
• Billing errors or unauthorized charges
• Legal requirements in your jurisdiction
• Other exceptional circumstances at our discretion

5. Cancellation Policy

You may cancel your premium subscription at any time through your account settings or billing page. Cancellation policies vary by subscription type:

5.1 Monthly and Annual Subscriptions

When you cancel a recurring subscription:

• Your subscription will not auto-renew for the next billing cycle
• You will continue to have access to premium AI models and features until your current subscription expires
• After expiration, your account will automatically downgrade to the free Basic tier
• No refunds will be provided for the unused portion of your subscription period (except as outlined in Section 4)
• You can resubscribe at any time, but will be subject to current pricing and will no longer be eligible for first-time user refunds

5.2 Lifetime Purchases

Lifetime purchases cannot be cancelled as they are one-time payments. However:

• First-time premium users may request a refund within 3 days of purchase (see Section 4)
• Your lifetime access remains active unless your account is terminated for Terms violations
• Access continues for the lifetime of the service

The Axols Local AI Tools platform, including all AI models, software, and related materials, are the property of HubtersAI, LLC or its licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive license to:

• Create content using our tools (you own the content you create)
• Use AI-generated results for commercial purposes, including selling products or services created with our tools
• Share results generated by our tools, subject to these Terms

You are expressly prohibited from:

• Extracting, downloading, or attempting to access the underlying AI models or authentication tokens
• Redistributing, selling, or licensing our AI models, tokens, or software to third parties
• Using our tools to create competing AI services or platforms
• Abusing our AI models through excessive automated requests or attempts to overwhelm our systems
• Sharing, exposing, or compromising authentication tokens or API keys
• Removing or altering any proprietary notices or branding

9. Account Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.

Grounds for termination include:

• Violation of our Acceptable Use Policy
• Fraudulent or illegal activity
• Abuse of our services, AI models, or authentication systems
• Unauthorized access to, extraction of, or distribution of our AI models or tokens
• Excessive automated usage or attempts to overwhelm our systems
• Accessing premium AI models or features without proper payment or authorization
• Sharing premium account credentials or attempting to bypass payment systems
• Failure to pay required fees

Upon termination, you will lose access to premium features, advanced AI models, and any content stored on our servers. We recommend downloading any important content before terminating your account. Lifetime purchases will be forfeited upon account termination for Terms violations, with no refund provided.

10. Disclaimers and Limitations

Our AI tools are provided "as is" without warranties of any kind. While we strive for accuracy, AI-generated content may contain errors or biases. You should verify important information and use your judgment when relying on AI-generated results.

To the maximum extent permitted by law, HubtersAI, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

Our total liability is limited to the amount you have paid us in the past twelve months, or in the case of lifetime purchases, the amount of your lifetime purchase.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved through binding arbitration in Delaware, except for small claims court matters.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through our website. Your continued use of our services after changes become effective constitutes acceptance of the new Terms.

However, pricing changes will not affect existing subscribers during their active subscription period, as outlined in Section 3.3.
